
Barrister Services are required where there is a Breach of a Statutory Order imposed by the Crown Court to the Probation Service.
Under the CJA 2003 every Crown Court order is now returned to the Crown Court which originally imposed the order.
The requirement to use Barristers exists in cases where both guilty and not guilty pleas are entered by the defendant. The Barrister role is either to present the case, or to present and defend the case in a not guilty plea, calling witnesses where necessary.
The prosecution papers with the necessary brief are prepared by the Probation Area (Service) holding the court order.
